By subscribing to the C Stream Pty Ltd products or services you agree to indemnify C Stream Pty Ltd and hold C Stream Pty Ltd harmless against any and all loss, cost, damage or other liability (including legal costs on a full indemnity basis) which C Stream Pty Ltd may incur from or in connection with a claim by any third party arising from a breach by you of any term. C Stream Pty Ltd reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you.

 

Refunds

 

C Stream Pty Ltd will honor any refund it has committed to in the sale of its services or products.  You agree never to perform a chargeback against C Stream Pty Ltd. If you perform a chargeback, C Stream Pty Ltd reserve the right to seek legal action to return the funds and any costs associated with the chargeback.

 

 

 

By subscribing to the C Stream Pty Ltd service, you acknowledge and agree to the terms and conditions of the sale as articulated by PayPal.

 

We will ensure the details of your personal records and account details held by us remain confidential.  However, if you lodge a claim in relation to an alleged incorrect or wrongful debit, it may be necessary for us to release such information to your financial institution or its representative, or to our financial institution or its representative to enable your claim to be assessed.

 

ENROC End User Licence Agreement (EULA)

 

If you subscribe and use the ENROC Software, you are agreeing to the terms of this agreement. Use of the application is subject to this agreement. If you do not agree to the terms of this agreement then unsubscribe from the software

C Stream Pty Ltd grants you a non-exclusive right to use this software and any accompanying materials according to the following:
You May
  1. use the software provided your subscription is current
You May Not
  1. modify, reverse engineer, or copy (except for the backup copy) the software or accompanying materials; or
  2. rent or transfer the title of the software
This license is not a sale. Title and copyrights to the Software and accompanying materials remains with C Stream Pty Ltd and its licensors. Any breach terminates this agreement.

LIMITED WARRANTY, DISCLAIMER, AND LIMIT OF LIABILITY
In the event of the software becoming unavailable or inoperatable for a period of more than seven (7) days, the user will not be billed further.

 

C Stream Pty Ltd and its licensors do not warrant your data, that the Software will meet your requirements, or that the operation will be uninterrupted or error free.

THE WARRANTY ABOVE IS IN LIEU OF ALL OTHERS, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. SOME STATES HAVE LAWS THAT MAY RESTRICT OR PROHIBIT THE LIMITATIONS SET FORTH ABOVE AND YOUR RIGHTS UNDER LAW MAY VARY ACCORDING TO THE LAWS OF YOUR STATE.

C Stream Pty Ltd and its licensors shall not be liable for any incidental or consequential damages, including loss of data, lost profits, cost of cover, or other special or indirect damages. Your rights under law may vary.

 

GOVERNING LAW AND JURISDICTION
The law of Queensland, Australia governs this agreement.
